The purpose of this document is to provide CDTOA members and affiliates with the current status of the CARB On-road Truck & Bus Rule or the “Rule”. The Rule is in full force and effect and has not been “delayed” or “suspended” as Transport Topics recently indicated.  In September 2010, the Rule will likely be further modified for fleets of four or more trucks subject to the Rule. As a result of the April 22nd Board meeting, over the next four to five months, CARB staff was directed to work on:

 

 

  1. Increased mileage thresholds (e.g. raise the limit for trucks that can operate on a diesel particulate filter prior to replacement);
  2. Reduce particulate matter (PM) compliance percentages;
  3. Allow credits for early action to extend beyond 2014
  4. Get the emission inventory numbers right (Note:  The Off-road Rule emissions inventory that were used as the basis for the rule were 600% HIGHER than what outside experts now calculate is real).

 

Facts:

  1. On December 12, 2008, the California Air Resources Board (CARB) approved the Rule to reduce emissions from existing on-road diesel powered vehicles operating in California, regardless of their origin. The regulation requires truck owners to fill out their (CARB’s) reporting documentation by January 2011 at the latest and to meet performance requirements between 2011 and 2023.
  2. At the CARB board hearing held on December 9, 2009 the Board directed staff to propose amendments to the Rule that would provide additional flexibility for fleets adversely affected by the economy.
  3. The Rule became law on January 8, 2010 and requires that by January 1, 2023 all vehicles must have a 2010 model year diesel engine or equivalent. A large portion of the cost of the Rule, probably 75 percent of the cost of compliance will kick in between 2011-2014 for industry.
  4. CARB Staff has also floated a relaxed compliance schedule for a “medium” fleet size of 4 to 20 trucks. This would defer any performance requirements during 2011 and 2012 but require 60% fleet compliance by 2013 and 100% by 2014.
  5. There was no indication at yesterday’s hearing that CARB staff plans to change particulate matter (PM) and oxides of nitrogen (NOx) compliance deadlines in 2014, however the construction industry will seek to shift the 2011-2013 further out based on faulty emissions inventory data exposed yesterday.
  6. CDTOA and other allied organizations are mounting strategies for the upcoming CARB meetings with the goal of achieving a meaningful delay or suspension of the Truck Rule and the AB 32 Program. If AB 32 is suspended it will have no direct effect on CARB’s diesel rules.
  7. CDTOA, a member of CIAQC, is also supporting efforts to slow-down the off-road diesel engine rule as well.
